Environmental and Land Use Practice Group

The Environmental and Land Use Practice Group's work encompasses a number of disciplines, including real estate law, land use law, environmental law, water law and natural resources law. This Group handles varying projects in terms of both subject matter and scale. This breadth of knowledge allows our attorneys to service diverse clients, including professional developers, property owners, engineers and contractors, and to offer our clients a wide range of consulting and litigation services in the areas of environmental and land use law.

The services offered by the Environmental and Land Use Practice Group include:

  • Identifying and evaluating environmental concerns and impacts of existing and proposed projects;

  • Interacting with regulatory entities, including city and county governments; regional and state agencies, such as the Regional Water Quality Control Board, State Water Resources Control Board, the California EPA and the Coastal Commission; as well as federal agencies, such as the U.S. Department of Oil and Gas, U.S. Fish and Wildlife Service, and Army Corps of Engineers;

  • Working with agencies, business interests and property owners to formulate, negotiate and implement remediation strategies and plans;

  • Assisting clients in navigating through the requirements of numerous state and federal laws such as CERCLA, the Endangered Species Act, Clean Water Act, including wetlands regulation, Clean Air Act, National Environmental Protection Act, and the California Environmental Quality Act;

  • Advising clients regarding land use, zoning and permitting issues, including obtaining, utilizing and protecting entitlements and vested rights in real property;

  • Overseeing the parcel map, tentative map and final tract map processes, and for residential subdivisions, the Department of Real Estate Public Report application process;

  • Providing agreements associated with the development of both residential and commercial real property, including CC&R's, easements, open space agreements and development agreements; and

  • Consulting with clients to resolve various Subdivision Map Act compliance issues, such as lot line adjustments, mergers and certificates of compliance.

The combination of our environmental and land use practices into a single practice group allows the efficient and effective coalescence of these two areas of law for the benefit of our clients.
